This Privacy Policy describes the policies and procedures of Accurence. Inc. (“Accurence”) on the collection, use and disclosure of information we collect from users of our website, located at www.accurence.com, client specific URLs for web applications, the SettleAssistTM product, ScopeAssist™, and any other products, and related services (collectively, the “Services”). When using any of our Services you consent to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy. Irrespective of which country that you reside in or create information from, your information may be used by Accurence in the United States or any other country where Accurence operates.

INFORMATION COLLECTION AND USE

INFORMATION COLLECTED FROM YOU: If you create or reconfigure an Accurence account, you provide some personal information, such as your first and last name, mailing address, professional title, company name, username, password, contact phone number, and email address. When you use the Services, you may provide information describing a loss event, including but not limited to notes, photographs, policyholder name, insurance policy information, policyholder contact information, property characteristics, property materials, aerial CAD data, measurements, inspection reports, and damage information. We also retain information on your behalf, such as files, reports, photographs, and messages that you store using your account. If you provide us feedback or contact us via e-mail (e.g., in response to an employment opportunity posted on our website), we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply, and any information that you submit to us, such as a resume. We may also collect personal data, such as demographic information, from you via the Services or at other points in our website that state that information is being collected.

INFORMATION COLLECTED VIA TECHNOLOGY: To make our Services more useful to you, our servers (which may be hosted by a third party service provider) collect information from you, including browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit. We also use Cookies (as defined below) and navigational data like Uniform Resource Locators (URL) to gather information regarding the date and time of your visit and the information for which you searched and which you viewed. Like most Internet services, we automatically gather this personal information and store it in log files each time you visit our website or access your account on our network. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a web site. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our website. Persistent Cookies can be removed by following Internet browser help file directions. If you choose to disable Cookies, some areas of our website may not work properly.

LOCATION-BASED INFORMATION: To provide location-based services, we and our partners may collect, use, transmit, process, store and share precise location data about your use of the Services. This information may include but is not limited to your account information and name, and real-time geographic location of your device. You may also submit to us location data from loss event and other information. We may share geographic location data with our service providers and clients when you use our location-based services. By using the Services and applications that depend on location-based information, you agree and consent to us collecting, using, transmitting, processing, storing and sharing information related to your account and the devices registered to your account for purposes of providing such location-based services or features to you. We do not guarantee the availability, accuracy, completeness, reliability, or timeliness of location data or any other data displayed by the service. The location-based services are not intended or suitable for use as an emergency locator system.

GENERAL USE: In general, information you submit to us is used to perform our services, to respond to requests that you make, or to aid us in serving you better. We may use your information to: facilitate the creation of and ensuring the security of your account on our network; identify you as a user in our system; provide improved administration of our website and Services; improve the quality of experience when you interact with our website and Services; send you a welcome e-mail to verify ownership of the e-mail address provided when your account was created; send you administrative e-mail notifications, such as security or support and maintenance advisories; respond to your inquiries related to employment opportunities or other requests; to send promotional communications; to provide you with hardcopy or electronic newsletters, or surveys; or to make telephone calls to you, from time to time, as a part of secondary fraud protection or to solicit your feedback. Additionally, if you are an insurance adjuster submitting loss information, we will use your information to provide our SettleAssist services to our clients. Additionally, if you are a contractor submitting inspection information, we will use your information to provide our ScopeAssist services to our clients.

We may send upgrades and special offers related to our Services and for other marketing purposes of us or our partners, should you opt-in to receive such communications by following the instructions we provide.

If you provide feedback on any of our Services or related services to us, we may use such feedback for any purpose, provided we will not associate such feedback with your identifiable information. Accurence will collect any information contained in such communication and will treat such data in such communication in accordance with this Privacy Policy.

THIRD PARTIES: We may receive information about you from other sources like telephone or fax, or from companies that assist us in the provision of our Services, including the insurance companies with whom we do business. If you are an insurance adjuster submitting loss information, the insurance compan(ies) with whom you are associated may supply us with your name and contact information, skills, training, and time with the company amongst other data. If you are a contractor salesman submitting inspection information, the contracting compan(ies) with whom you are associated may supply us with your name and contact information, skills, training, and time with the company amongst other data. We may add this information to the information we have already collected from you via our website in order to improve the Services we provide. Accurence uses a variety of services hosted by third parties to help provide our Servicess and to help us understand the use of our Services, such as Google Analytics. These services may collect information sent by your browser as part of a web page request, such as cookies or your IP request. Our provision of a link to any other website or location is for your convenience and does not signify our endorsement of such other website or location or its contents. When you click on such a link, you will leave our site and go to another site. During this process, another entity may collect data from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Policy do not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites.

INFORMATION SHARING AND DISCLOSURE

YOUR CONSENT: We may share or disclose your information with your consent. If you are an insurance adjuster submitting loss information, we will share all submitted information with the insurance compan(ies) with whom you are associated. If you are a contractor salesman submitting inspection information, we will share all submitted information with the contracting compan(ies) with whom you are associated.

AFFILIATES: Although we currently do not have a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”), we may in the future. We may share some or all of your information with these Affiliates, in which case we will require our Affiliates to honor this Privacy Policy.

SERVICE PROVIDERS: We engage certain trusted third parties to perform functions and provide services to us. We may share your personal information with these third parties, but only to the extent necessary to perform these functions and provide such services, and only pursuant to obligations mirroring the protections of this privacy policy.

LAW AND HARM: We may preserve or disclose your information if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect Accurence’s rights or property.

BUSINESS TRANSFERS: In the event that Accurence is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. The promises in this privacy policy will apply to your information as transferred to the new entity.

NON-PRIVATE OR NON-PERSONAL INFORMATION: We may share or disclose your non-private, aggregated information to third parties.

A NOTE TO USERS OUTSIDE OF THE UNITED STATES. Your personal information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of personal information a may be less stringent than the laws in your country. We adhere to the United States / European Union Data Protection Safe Harbor Arrangement, which can be located at http://www.export.gov/safeharbor.

YOUR CHOICES REGARDING YOUR PERSONAL DATA

If you are a registered user of our Services, we provide you with tools to access or modify the personal information you provided to us and associated with your account.

When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly (please see contact information below). Should you decide to opt-out of receiving future mailings, we may share your e-mail address with third parties to ensure that you do not receive further communications from third parties. Despite your indicated e-mail preferences, we may send you notices of any updates to our Terms of Use or Privacy Policy.

You may change any of your personal information in your account by editing your profile within the application or by sending an e-mail to us at the e-mail address set forth below as applicable. You may request deletion of your personal information by us, but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives.

Accurence is committed to protecting the security of your personal information. We use a variety of industry-standard security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure. We also require you to enter a password to access your account information. Please do not disclose your account password to unauthorized people. Despite these measures, you should know that Accurence cannot fully eliminate security risks associated with personal information and mistakes may happen.

OUR POLICY TOWARDS CHILDREN

Our Services are not directed to people under 13. If you become aware that your child has provided us with personal information without your consent, please contact us at privacy@accurence.com. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we take steps to remove such information and terminate the child’s account.

DISPUTE RESOLUTION

If you believe that Accurence has not adhered to this Statement, please contact Accurence by e-mail at privacy@accurence.com. We will do our best to address your concerns. If you feel that your complaint has been addressed incompletely, we invite you to let us know for further investigation. If we are unable to reach a resolution to the dispute, we will settle the dispute exclusively under the rules of the American Arbitration Association (www.adr.org).

COPYRIGHT POLICY

Accurence respects the intellectual property of others and asks that users of our Services do the same. In connection with our site, we have adopted and implemented a policy respecting copyright law that provides for the removal of any infringing materials and for the termination, in appropriate circumstances, of users of our Services who are repeat infringers of intellectual property rights, including copyrights. If you believe that one of our users is, through the use of our Services, unlawfully infringing the copyright(s) in a work, and wish to have the allegedly infringing material removed, the following information in the form of a written notification (pursuant to 17 U.S.C. § 512(c)) must be provided to our designated Copyright Agent:

  • identification of the copyrighted work(s) that you claim to have been infringed;
  • identification of the material on our services that you claim is infringing and that you request us to remove;
  • sufficient information to permit us to locate such material;
  • your address, telephone number, and e-mail address;
  • a statement that you have a good faith belief that use of the objectionable material is not authorized by the copyright owner, its agent, or under the law; and
  • a statement that the information in the notification is accurate, and under penalty of perjury, that you are either the owner of the copyright that has allegedly been infringed or that you are authorized to act on behalf of the copyright owner.

Please note that, pursuant to 17 U.S.C. § 512(f), any misrepresentation of material fact (falsities) in a written notification automatically subjects the complaining party to liability for any damages, costs and attorney’s fees incurred by us in connection with the written notification and allegation of copyright infringement.

CHANGES TO THIS POLICY

We may revise this Privacy Policy from time to time. The most current version of the policy will govern our use of your information and will always be at www.accurence.com/privacy. If we make a change to this policy that, in our sole discretion, is material, we will notify you via an update to your account, or e-mail to the email associated with your account. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.
